General Terms and Conditions
1. Areas of application
1.1 Our sale, delivery and payment terms and conditions apply for all purchasing agreements and offers. These conditions are acknowledged by our customers when they place an order, conclude a contract or accept our delivery. Aberrant terms and conditions set by our customers or delivery service providers, which we do not explicitly accept, are for us without obligation, even if this is not explicitly stated in these terms and conditions.
1.2 Our terms and conditions also apply for follow-up transactions, without the need for an explicit acknowledgement.
2. Quote/formation of a contract
2.1. The offers on our website are without obligation. Informations and offers on our website are not promised or guaranteed to be correct, current, or complete, and this site may contain technical inaccuracies or typographical errors. Customer has no right to take legal step against us.
2.2. Our Online Store is not an offer in legal sense. Contracts come first through customers’ orders and are validated with our written confirmation of order, or through delivery of goods.We accept the order automatically by our shopsystem. In all cases, the receipt of your order will be confirmed immediately. We can accept your order by sending an order confirmation via e-mail or by delivery of the goods within five days.
2.3. We record the text of the contract and send you the order data and our general terms and conditions per e-mail. Our general terms and conditions are also available on our website. You can review your previous orders in our customer Login area.
Prices and Payment
3.1. Prices are valid at the time of order. All prices include VAT and packaging but exclude postage.
3.2. In case customer cancels order after payment has been done, we are obliged to credit the prepayment or to refund by bank transfer on request immediately. If customer revokes only a part of the order, we will only refund the value of goods and the difference of freight costs for this part.
4. Delivery and shipping costs
4.1. You may find our current valid shipping costs in section "Shipping & Delivery".
4.2. The beginning of the delivery time indicated by us presupposes the punctual and proper fulfillment of the obligations of the consumer. Delivery of the product is carried out only after receipt of payment. In case of delays in delivery Folienhandel.eu will immediately inform customer by e-mail.
4.3. The informations about delivery times are to be considered approximate. They are noncommital for us. Deliveries are carried out nationally (usually 2 to 4 workdays) and within Europe (usually 3-6 working days).
4.4. If customer defaults on acceptance or he/she neglects culpably other duties of cooperation, we are entitled to require compensation for the damage resulting from this default including any additional expenses. The right to further claims is reserved. The customer is entitled to prove that damage has been incurred at all, or at least significantly lower in the requested amount.
4.5. The specified delivery dates submitted by us are approximate agreed and understood subject to unforeseen circumstances and obstacles such as force majeure, labor shortages, riots, strikes, lockouts, war, energy and raw material shortages, failure of transport vehicles, and other involuntary delayed supply. In such a delay in delivery, the delivery period shall be extended appropriately. We will inform our customer about the beginning and end of such obstacles as soon as possible. If the impediment which is not represented by us is longer than 2 months, every party is entitled to terminate the contract without compliance with a period of notice.
5. Reservation of ownership
The delivered goods remain our property until we received full payment.
6. Cancellation policy
Cancellation right
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

7. Warranty and liability
7.1. Obvious deficiencies have to be indicated in written form within 3 calendar days after receipt of delivery through the parcel service. This period is a limitation period.
7.2. Faulty deliveries or services can be delivered or mended at our choice. Should these measures fail, the customer shall be entitled to reduce the purchase price or to revoke the contract. It is to be assumed a failure, if additional supply or cure by either rectification or replacement is impossible, refused by us in writing, a deadline of two weeks containing a refusal of ineffective performance or our rectification fails twice. We are entitled, in either case, to request rectification or additional supply.
7.3. Further guarantee claims are excluded. However, we are liable for the lack of warranted qualities as designated by law.
7.4. A warranty claim does not apply if the deficiency is based on the fact that processing instructions were ignored by the customer or required performance levels have been exceeded. Any changes or modifications of the product will void warranty. You may not process films at temperatures less than/equal to 3°C and night temperatures should be observed.
7.5. We issue a guarantee up to 2 years for some kind of films, all further particulars are stated under the respective product information. The guarantee of films does not apply if they have been processed incorrectly or cleaned improperly. The inclusion of small dust particles in the film coating can not always been completely excluded. Consequently no warranty claims can be invoked. There are no warranty claims in cases of damage caused by external factors or due to improper processing. Variations in shades and measures and price changes are formally reserved. We are not liable for breakage of glass or other damages, emerging after a film coating. The acception of costs, regardless of which kind is explicitly excluded. Our technical informations are based on noncommital manufacturer’s instruction.
7.6. We shall be entitled to refuse the performance of warranty claims as long as the customer does not pay the contractual fee, less depreciation in consideration to the deficiency or if the customer does not meet other substantial contractual obligations.
7.7. We are, in principle, not liable for mistakes, resulting from imprecisely submitted records or data (e.g. oral statements, drawings) by the customer.
8 Place of execution and competent court (of jurisdiction)
8.1 The place where all obligations of the contract agreement from the contractual relationship are fulfilled is Hückelhoven.
8.2 Under the premises that our customer is a business client or any of the other prerequisites of the section § 38 of the code of civil procedure are on hand, the jurisdiction for all legal disputes, is Hückelhoven. The same applies to disputes which affect the accomplishment and validity of the contract.
9. Void in part
Should one or more of the above mentioned regulations be fully or partially invalid, this will not affect the validity of the remaining determinations. The invalid regulation will be replaced by a valid one which comes next to the economic purposes of the invalid one.
